Terms of Sale

These terms apply when you buy a Birdfolio book or gift card on mybirdfolio.com. Please read the short version at least.
The short version
- Each Birdfolio is made just for you, so it can't be returned if you change your mind.
- You can cancel for a full refund until your book goes to print, 6 hours after you order.
- Damaged, defective or misprinted? Send us a photo within 7 days of delivery and we'll reprint it free.
- We ship to US addresses only for now.
- Delivery dates are estimates. If we can't ship on time, we'll tell you, and you can cancel for a full refund.
- Gift cards never expire and have no fees.
- Birdfolio is independent. We're not affiliated with or endorsed by eBird, the Cornell Lab of Ornithology or iNaturalist.
1. Who we are
Birdfolio is based in Estonia.

"We", "us" and "Birdfolio" mean Birdfolio, the seller behind mybirdfolio.com. "You" means the person placing the order.
2. What we sell
- Birdfolio books: a hardcover book (8.5 × 11 in) made from your own bird sightings. Each species appears beside a classic painting or an openly licensed photograph, with the date and place you first saw it. Sizes: Standard, Complete and Grand.
- Birdfolio gift cards: a code, sent by email, that someone else can use toward a book (section 9).
3. Who can order
- You must be 18 or older.
- We ship only to addresses in the United States: the 50 states and Washington, DC.
- PO boxes: Standard shipping only. Express can't be delivered to a PO box.
- We don't ship to APO/FPO/DPO addresses, or to US territories yet.
- Books are for personal use. For group, club or tour orders, email us first.
4. Your preview, and what you approve
- Your book is built from the file or list you give us. Before you pay, you see a free preview made in your browser.
- Please check it carefully: names, dates, places, the title, the name on the cover and any dedication. We print what you approve.
- We don't check whether your sightings are correct. The book shows what your records say.
- Place names are printed as they appear in your file. If you named a location after your home address, change it in your file or preview before you order.
- Bird names follow AviList, a global checklist of the world's birds. If a species has been split or merged since you logged it, we match it as closely as we can, and a notes page in the book explains the change.
- The preview is a close guide, not an exact match: printed colors can differ slightly from your screen.
5. Prices and payment
- Prices are in US dollars. Book prices include Standard shipping to a US address; Express shipping costs extra.
- The total (book, any extra shipping and any tax) is shown before you pay.
- We don't currently charge US sales tax. If that changes, the tax will be shown at checkout before you pay.
- Payments are handled by Stripe. We never see your full card number.
- If a price on our site is clearly wrong (for example, $7.90 instead of $79), we'll contact you before we make your book. You can then pay the right price or cancel for a full refund.
6. When your order is confirmed
- Your order is accepted when we send you the order confirmation email. It includes a copy of these terms, or a link to the version that applied when you ordered.
- If we can't make your book (for example, your file can't be read, or it contains content we won't print; see section 10), we'll tell you and refund you in full.
7. Made to order: no change-of-mind returns
- Each Birdfolio is made to your specifications and clearly personalized. So we can't take it back, exchange it or refund it just because you changed your mind.
- EU notice: we're based in the EU. Under EU consumer law, the 14-day right of withdrawal does not apply to goods made to the consumer's specifications or clearly personalized (Directive 2011/83/EU, Article 16(c)).
- Cancel before printing: you can cancel for a full refund until we send your book to print, which happens 6 hours after you place your order. Email hello@mybirdfolio.com with your order number. After that, printing has started and can't be stopped.
- This doesn't affect your rights if your book is damaged, defective or misprinted (section 8).
8. Damaged, defective or misprinted books
- If your book arrives damaged, has a printing or binding defect, or doesn't match the preview you approved, email us a photo within 7 days of delivery with your order number. We'll reprint it free, including shipping. You don't need to send the book back.
- If a reprint isn't possible, we'll refund you in full.
- Not covered: errors that were in the data or text you approved (section 4), and small color differences between screen and print.
- We delete your book files 30 days after delivery (see our Privacy Policy). If you contact us after that, we may ask you to upload your file again so we can remake the book, or we'll refund you.
- This promise is in addition to your legal rights, not instead of them. Under EU law (which governs these terms; section 16), a seller is responsible for defects that exist at delivery and show up within two years. Where that or your local law gives you more, you get it.
9. Gift cards
- A Birdfolio gift card is a code worth a dollar amount, sent by email with a printable card. We email it to you right away, or, if you ask, straight to the recipient on the date you choose (from 7 AM US Eastern time that day), with your receipt to you right away.
- It never expires and has no fees.
- The recipient uses it toward any Birdfolio book (US shipping is already in the book price) and, if they choose it, Express shipping. They upload their own list when they're ready, and we make their book then. So a gift card bought just before a birthday or a holiday means the book arrives after that day; the gift card itself arrives right away, or on the date you chose.
- If the book costs more than the card, the recipient pays the difference. If it costs less, the rest stays on the code for later. If the balance left is under $15, we'll pay it out on request.
- One gift card code per order. Codes can't be combined with other discount codes.
- Refunds: the buyer can cancel an unused gift card for a full refund within 14 days of buying it. After that, gift cards can't be exchanged for cash, except as described above or where the law requires.
- Treat the code like cash. If the email is lost, we'll resend it to the buyer's email address (or, if you asked us to email it to the recipient, to theirs). Please check the recipient's email address: we can't replace a code someone else has already used.
- When the recipient redeems the card, these terms apply to their book order, and they agree to them at that point.
10. Your content: sightings, names, dedication and photos
- Your sightings: you confirm the records are your own, or that the person whose records they are has agreed to you making this book.
- Your photos: if you add your own photos, you confirm, by ticking "I took these photos, or I have the photographer's permission to print them.", that you took them, or that the photographer has given you permission to have them printed in your book with the credit you enter (for example "Photo: Tom Hill"). Please don't add photos you aren't allowed to use.
- You keep all rights in your photos and your words. You give us a limited, non-exclusive, royalty-free license to use your photos only to make, preview, print, ship and (if needed) reprint the book in this order, and for nothing else, unless you choose to share a photo (below). The license ends when we delete them: 30 days after delivery, or, if you tick "Keep my photos for a reprint (up to 1 year)", one year after delivery, or sooner if you ask us. We never use your photos in marketing and never publish them or your book.
- We may refuse to print content that is unlawful, infringes someone else's rights, or is hateful, harassing or sexually explicit. If we do, we'll tell you and refund you in full.
Photos you choose to share
- When you add one of your own photos, you can tick "Share this photo with other birders?". It's optional, and it starts unticked. You can share only a photo you took yourself: you confirm that by ticking "I took this photo myself".
- If you share a photo, you give Birdfolio a non-exclusive, worldwide, royalty-free, perpetual license to reproduce it, cropped or resized, in other customers' printed Birdfolio books and in the previews of those books. We always credit it with the name you give us (for example "Photo: Margaret H.").
- You keep the copyright, and you can still use your photo however you like. We don't pay for shared photos, and we may decide not to use a photo you share.
- We never use a shared photo in advertising or marketing, unless we ask you separately and you agree.
- You can withdraw at any time by emailing hello@mybirdfolio.com. We then delete our copy and stop using it in new books; books already printed stay as they are.
- Sharing changes nothing about your own book or your order.
11. Our content
- The book design and layout, the text we write, our maps and the Birdfolio name belong to us or our licensors.
- Paintings and photographs in the book aren't ours: each one is credited at the back of the book, and photographs are used under their open licenses. Details: our Credits and Licenses page.
- Your printed book is yours to keep, give, lend or sell as a physical copy. Please don't copy our layouts to make other books or products.
12. eBird and other services
- You can make a Birdfolio from files you download from other services, such as eBird or iNaturalist. Birdfolio is independent. We're not affiliated with or endorsed by eBird, the Cornell Lab of Ornithology or iNaturalist, or by any other service whose files we can read. We name them only to say which files work.
- Please upload only your own records. When you download data from another service, that service's terms apply to you.
13. Our responsibility to you
- We make each book with care and will fix problems as described in section 8.
- Nothing in these terms limits your rights under consumer law that can't be waived, or our responsibility for death or personal injury caused by our negligence, or for fraud, intent or gross negligence.
- Apart from that, our total liability for an order is limited to the amount you paid for it. We're not responsible for losses we couldn't reasonably have foreseen, or for business losses: a Birdfolio is for personal use.
14. Things outside our control
If something outside our reasonable control (for example, a carrier or printer outage, a natural disaster or a strike) delays or stops an order, we'll tell you as soon as we can and follow the delay rules in our Shipping and Returns policy, including your right to cancel for a full refund.
15. Reviews
You're free to review Birdfolio honestly, good or bad. Nothing in these terms restricts that.
16. Governing law and disputes
- Talk to us first. Email hello@mybirdfolio.com. We reply in writing within 15 days.
- These terms are governed by the laws of Estonia, where Birdfolio is based.
- You keep the protection of the consumer laws of the place where you live (for example, your US state) that can't be waived by contract. Nothing here takes that away.
- You can bring a claim in the courts of Estonia, or in the courts of the place where you live if your local law allows it.
17. Orders on Etsy
If you buy a Birdfolio through our Etsy shop, Etsy's own terms and policies also apply. Where Etsy's purchase protection gives you more than these terms, you get the better of the two.
18. Other legal bits
- Privacy: how we handle your data is explained in our Privacy Policy.
- Changes: we may update these terms. The version that applied when you placed your order applies to that order.
- If a court finds part of these terms invalid, the rest still applies.
- These terms, our Privacy Policy and our Shipping and Returns policy are the whole agreement between you and us about your order.
- You can save or print these terms at any time from mybirdfolio.com/terms, and we email you a copy with your order.
